Introduction

Highten, LLC (“Company”, “we” or “us”) respect your privacy and are committed to protecting it through our compliance with this privacy policy (this “Privacy Policy”).

This Privacy Policy describes how we and some of the companies we work with collect, use, share and protect information in relation to our website www.hightensifter.com (the “HIGHTEN Site”) and any mobile application we offer (the “HIGHTEN App,” and together with the HIGHTEN Site, the “HIGHTEN Platform”) and our practices for collecting, using, maintaining, protecting, and disclosing that information.

We recognize that the privacy of your information is important to you, and it is of paramount importance to us. The purpose of this Privacy Policy is to let you know how we handle the information you voluntarily provide to us or that we collect through your voluntary use of the HIGHTEN Platform. It is our policy to notify users (and obtain their acceptance) of our Privacy Policy and our Terms of Use (found here) with a notice on the HIGHTEN Platform home page during the user’s first visit to the HIGHTEN Platform and whenever there is a material change to our Privacy Policy or our Terms of Use.

We are a young company and are continuously working to better support and serve the security needs of our growing userbase and business partners.

Please understand that your use of the HIGHTEN Platform is strictly voluntary. If you believe your use of the HIGHTEN Platform is not voluntary, at any time, for any reason, please contact us immediately.

This Privacy Policy applies to information we collect:

  • on this HIGHTEN Platform; and

  • in email and other communications between you and us.

It does not apply to information collected by:

  • us offline or through any other means, including on any other website operated by Company or any third party (including our affiliates and subsidiaries); or

  • any third party, including through any application or content (including advertising) that may link to or be accessible from or on the HIGHTEN Platform.

Please read this Privacy Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use our HIGHTEN Platform. By accessing or using this HIGHTEN Platform, you agree to this Privacy Policy. This Privacy Policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of this HIGHTEN Platform after we make changes is deemed to be acceptance of those changes, so please check this Privacy Policy periodically for updates.

You must be 25 years of age or older in order to use the HIGHTEN Platform. You represent and warrant that any profile information you submit is true and accurate and that you are 25 years of age or older. The HIGHTEN Platform is not intended for those under the age of 25. We may restrict access to HIGHTEN Platform from certain locations.

Persons Under the Age of 25

Our HIGHTEN Platform is not intended for persons under 25 years of age. No one under the age of 25 may provide any personal information to or on the HIGHTEN Platform. We do not knowingly collect personal information from persons under 25 years of age. If you are under 25, do not use or provide any information on this HIGHTEN Platform or on or through any of its features/register on the HIGHTEN Platform, make any purchases through the HIGHTEN Platform, use any of the interactive or public comment features of this HIGHTEN Platform or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a person under 25 without verification of parental consent, we will delete that information. Information We Collect About You and How We Collect It

We collect several types of information from and about users of our HIGHTEN Platform, including information:

  • by which you may be personally identified, such as name, e-mail address or any other identifier by which you may be contacted online or offline (“personal information”);

  • that is about you but individually does not identify you; and/or

  • about your internet connection, the equipment you use to access our HIGHTEN Platform and usage details.

We may collect this information:

  • directly from you when you provide it to us;

  • automatically as you navigate through the site. Information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies; or

  • from third parties.

Information You Provide to Us  

The information we collect on or through our HIGHTEN Platform may include:

  • Information that you provide by filling in forms on our HIGHTEN Platform. This includes information provided at the time of registering to use our HIGHTEN Platform or purchasing our products. We may also ask you for information when you report a problem with our HIGHTEN Platform.

  • Records and copies of your correspondence (including email addresses), if you contact us.

  • Details of transactions you carry out through our HIGHTEN Platform and of the fulfillment of those transactions. You may be required to provide financial information before placing an order through our HIGHTEN Platform.

Information We Collect Through Automatic Data Collection Technologies  

As you navigate through and interact with our HIGHTEN Platform, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

  • Details of your visits to our HIGHTEN Platform, including traffic data, location data, logs, and other communication data and the resources that you access and use on the HIGHTEN Platform.

  • Information about your computer and internet connection, including your IP address, operating system, and browser type.

We also may use these technologies to collect information about your online activities over time and across third-party websites or other online services (behavioral tracking). The information we collect automatically is statistical data and does not include personal information, but we may maintain it or associate it with personal information we collect in other ways or receive from third parties. It helps us to improve our HIGHTEN Platform and to deliver a better and more personalized service, including by enabling us to:

  • Estimate our audience size and usage patterns.

  • Store information about your preferences, allowing us to customize our HIGHTEN Platform according to your individual use.

  • Recognize you when you return to our HIGHTEN Platform.

The technologies we use for this automatic data collection may include:

  • Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of our HIGHTEN Platform. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our HIGHTEN Platform.

  • Flash Cookies. Certain features of our HIGHTEN Platform may use local stored objects (or Flash cookies) to collect and store information about your preferences and navigation to, from, and on our HIGHTEN Platform. Flash cookies are not managed by the same browser settings as are used for browser cookies. We do not collect personal information automatically, but we may tie this information to personal information about you that we collect from other sources or you provide to us.

We use commercially reasonable safeguards to help keep the information collected through the HIGHTEN Platform secure and take reasonable steps (such as requesting a unique password) to verify your identity before granting you access to your account. However, we cannot ensure the security of any information you transmit to us or guarantee that information on the HIGHTEN Platform may not be accessed, disclosed, altered, or destroyed. Please do your part to help us. You are responsible for maintaining the secrecy of your unique password and account information, and for controlling access to emails between you and us, at all times.

How We Use Your Information

We use the information we have (subject to choices you make) as described below and to provide and support the HIGHTEN Platform, and the following describes how we do that.

We may use location-related information-such as your current location, where you live, the places you like to go, and the businesses and people you are near to provide, personalize and improve the HIGHTEN Platform and our products, including ads, for you and others. Location-related information can be based on things like precise device location (if you have allowed us to collect it) and IP addresses.

We may use the information we have to develop, test and improve the HIGHTEN Platform, including by conducting surveys and research, and testing and troubleshooting new services, products and features.

We may use the information we have (including your activity off the HIGHTEN Platform, such as the websites you visit and ads you see) to help advertisers and other partners measure the effectiveness and distribution of their ads and services, and understand the types of people who use their services and how people interact with their websites, apps, and services. We may also provide personalized content and information to you and others, which could include online ads or other forms of marketing.

We may use the information we have to verify accounts and activity, combat harmful conduct, detect and prevent spam and other bad experiences, maintain the integrity of the HIGHTEN Platform and our products, and promote safety and security. For example, we use data we have to investigate suspicious activity or violations of our terms or policies, or to detect when someone needs help.

We may use the information we have to send you marketing communications, communicate with you about the HIGHTEN Platform or our products, and let you know about our policies and terms. We also use your information to respond to you when you contact us.

In addition to some of the specific uses of information described above, we may more generally use information, including any personal information, that we receive:

  • To present our HIGHTEN Platform and its contents to you.

  • To provide you with information, products, or services that you request from us.

  • To fulfill any other purpose for which you provide it.

  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.

  • To notify you about changes to our HIGHTEN Platform or any products or services we offer or provide though it.

  • In any other way we may describe when you provide the information.

  • For any other purpose with your consent.

Disclosure of Your Information

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

We may disclose personal information that we collect or you provide as described in this Privacy Policy:

  • To third parties you contract with through the HIGHTEN Platform;

  • For any other purpose disclosed by us when you provide the information; or

  • With your consent.

Sharing with Third-Party Partners

Here are the types of third parties we share information with:

  • Advertisers. We may provide advertisers with reports about the kinds of people seeing their ads and how their ads are performing, but we do not share information that personally identifies you (information such as your name or email address that by itself can be used to contact you or identifies who you are) unless you give us permission. For example, we provide general demographic and interest information to advertisers (for example, that an ad was seen by a woman between the ages of 25 and 34 who lives in Chicago) to help them better understand their audience.

  • Service Providers. We also may share your information as well as information from tools like cookies and device identifiers and location data, with third-party organizations that help us provide the HIGHTEN Platform to you ("Service Providers"). Our Service Providers will be given access to your information as is reasonably necessary to provide the Service under reasonable confidentiality terms.

  • Law enforcement or legal requests. We share information with law enforcement or in response to legal requests in the circumstances outlined below

Other Sharing

  • We may remove parts of data that can identify you and share anonymized data with other parties. We may also combine your information with other information in a way that it is no longer associated with you and share that aggregated information.

  • We may share your information (including but not limited to, information from cookies, device identifiers, location data, and usage data) with businesses that are legally part of the same group of companies that we are a part of, or that become part of that group. Affiliates may use this information to help provide, understand, and improve the HIGHTEN Platform (including by providing analytics) and affiliates' own services (including by providing you with better and more relevant experiences). But these affiliates will honor the choices you make about who can see your content.

  • If we sell or otherwise transfer part or the whole of the Company or our assets to another organization (e.g., in the course of a transaction like a merger, acquisition, bankruptcy, dissolution, liquidation), your information such as name and email address and any other information collected through the HIGHTEN Platform may be among the items sold or transferred. The buyer or transferee will have to honor the commitments we have made in this Privacy Policy.

We may also disclose your personal information:

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request;

  • To enforce or apply our terms of use www.mubex.io/termsofuse and other agreements, including for billing and collection purposes; or

  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the Company, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

We access, preserve and share your information with regulators, law enforcement or others:

  • In response to a legal request (like a search warrant, court order or subpoena) if we have a good faith belief that the law requires us to do so. This may include responding to legal requests from jurisdictions outside of the United States when we have a good-faith belief that the response is required by law in that jurisdiction, affects users in that jurisdiction, and is consistent with internationally recognized standards.

  • When we have a good-faith belief it is necessary to: detect, prevent and address fraud, unauthorized use of the Service, violations of our terms or policies, or other harmful or illegal activity; to protect ourselves (including our rights, property or products), you or others, including as part of investigations or regulatory inquiries; or to prevent death or imminent bodily harm.

Information we receive about you can be accessed and preserved for an extended period when it is the subject of a legal request or obligation, governmental investigation, or investigations of possible violations of our terms or policies, or otherwise to prevent harm. We also retain information from accounts disabled for terms violations for at least a year to prevent repeat abuse or other term violations.

Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

  • Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly.

We do not control third parties' collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way.

Accessing and Correcting Your Information

You can review and change your personal information by logging into the HIGHTEN Platform and visiting your account profile page.

You may also send us an email at hi@hightensifter.com to request access to, correct or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Your Privacy Rights and Data Protection Practices

Certain users (such as users in California or the European Union/European Economic Area) may have additional rights and choices based on where they live. For example, certain users may have the following rights with respect to their personal information:

  • The right to know what information we collect from you, why it is collected, and how it is shared.

  • The right to have access to your user information in a portable format, to the extent technically feasible.

  • The right to have your user information deleted by us and to be notified when such deletion has been completed, colloquially known as the “right to be forgotten”.

  • The right to have incomplete or inaccurate user information rectified and to be notified upon rectification.

  • Withdraw your consent to the processing of your user information.

  • The right to request information about the categories of information that are sold and/or to opt out of the sale of personal information. (Note: what is covered as a “sale” under California law is not yet clear, but we currently do not “sell” your information, as we understand it.)

  • You may also have the right to lodge a complaint with the supervisory authority of your habitual residence, place of work or place of alleged infringement, if you consider that the processing of your personal data infringes applicable law.

If you are a resident of the European Union, we will process your personal information in compliance with the EU General Data Protection Regulation (“GDPR”).  To learn more about your GDPR privacy rights, visit https://eugdpr.org/the-regulation/ . For information submitted using the Service, CoutuRue is the data controller, as defined under GDPR.  In accordance with GDPR, as a data subject you will be accorded with any applicable rights under GDPR. We are committed to the free exercise of these rights without fear of being denied the opportunity to use the HIGHTEN Platform. If you would like to request to review, correct, restrict or delete personal information that you have previously provided to us, object to the processing of user information, or if you would like to request to receive an electronic copy of your user information for purposes of transmitting it to another company (to the extent this right to data portability is provided to you by applicable law), or exercise any other rights according to applicable law, please contact us at hi@hightensifter.com. We will respond to your request in accordance with the applicable law that governs the collection, use and deletion of your data and information. The requested deletion will be as comprehensive as possible but is always subject to issues outside of our control, including applicable regulations and laws, your actions and the actions of third parties. It is important to note that we may retain a copy of the information for archival purposes and to avoid identity theft or fraud.

You also have the right to lodge a complaint with the supervisory authority of your habitual residence, place of work or place of alleged infringement, if you consider that the processing of your personal data infringes applicable law.

If you are using the HIGHTEN Platform outside of the United States, your data and information is collected in the country in which you are located and is transferred to the United States or another country where our servers are located.  By registering for and using the HIGHTEN Platform you consent to the transfer of information to the U.S. or to any other country in which the Company maintain facilities and the use and disclosure of information about you as described in this Privacy Policy

Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls. Any payment transactions will be encrypted using SSL technology.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our HIGHTEN Platform, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our HIGHTEN Platform. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the HIGHTEN Platform.

Changes to Our Privacy Policy

It is our policy to post any changes we make to our privacy policy on this page with a notice that the privacy policy has been updated on the HIGHTEN Platform home page. If we make material changes to how we treat our users' personal information, we will notify you by email to the email address specified in your account and/or through a notice on the HIGHTEN Platform home page. The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our HIGHTEN Platform and this privacy policy to check for any changes.
